Reports are saying that an appeal may be filed soon for convicted Charlotte cop killer Demeatrius Montgomery. In 2007 Montgomery shot and killed Charlotte-Mecklenburg Police Officers Jeff Shelton and Sean Clark. Officers Clark and Shelton were responding to a domestic call and Montgomery was not involved with that call when killed the two officers.
The appeal is going to be based on the supposition that Montgomery should have been ruled incompetent to stand trial. Montgomery barely spoke to his own attorney and often refused to come out of his prison cell. The appeal is also going to make the accusation that the testimony of the officers’ widows was inappropriate. I guess killing two cops that had families isn’t inappropriate enough.
This is just another ploy for a twice-convicted killer to spend the rest of his days in a mental facility rather than a state prison. Given the choice which one would you rather spend time in?
However, the appeal may be for naught as the judge who presided over the trial stated that Montgomery’s silence will make it difficult to appeal.
