I’m actually sorry to hear that Tom Capano died in prison yesterday of an apparent heart attack but I’m getting ahead of myself.
For those of you not familiar with the case Tom Capano was a well-connected lawyer in Wilmington, Delaware. In the early 1990s he was having an affair with Anne Marie Fahey. Ms. Fahey was a secretary to the then governor of Delaware. She broke off the affair with Capano and when he tried to get back together with her after his wife left him he shot and killed Anne Marie. Capano stuffed her body into a cooler and dumped her body into the Atlantic Ocean off the coast of South Jersey. Her body to this day has never been found. Capano was a smug prick who acted like he would never be arrested let alone convicted. He was originally given the death penalty but that was overturned in 2006 and he was given a life sentence.
The reason that I’m kind of sad that he died in prison from a heart attack is because his family will get to bury him and mourn him properly. That’s something that Anne Marie’s family will never get.
If there was true justice Capano’s death sentence would have been upheld and he would have been shot in the back of the head then dumped into shark infested waters.
Everyone’s favorite Linux programming there’s no way he could have done it you can’t convict without a body wife killer Hans Reiser was beaten by other inmates at San Quentin. To answer your next question no he wasn’t killed nor severely injured.
He’s now been placed in special protective isolation. I wouldn’t doubt if Reiser planned this himself.
I know I said I wouldn’t post about Casey Anthony anymore but this is an issue that drives me insane.
I can’t stand it when everyone and their grandmother claims that you can’t convict without a body. While risky it’s not impossible and more common that you think.
Off the top of my head I can name two cases where people were convicted without a body. The first is Tom Capano. The body of Ann Marie Fahey was never found. The second one that comes to recent memory was that of Hans Resier. All of his supporters claimed that you can’t convict without the body of his wife Nina. After he was convicted he led police to his wife’s body.
There’s another case that the names of those involved escape me at this time but basically a guy from New Orleans went around bragging about killing a girl who no one even knew existed. Prosecutors in N.O. were able to convict him as well.
I think the Caylee Anthony disappearance fits very well next to those other cases. The only thing that will free Casey Anthony is if Caylee shows up alive and well. I think the odds of that happening are slim and none and slim just left.
I love how a metric assload of people said that there was no way they could convict Hans Reiser because there was no body. I love how they said how that he didn’t do it. I love how they said that he was convicted solely because he’s a geek.
Now they’re all silent because their hero is now trying to make a deal to get his sentence reduced if he shows them his wife’s body.
