In 2011, Timothy Smith of Woodstock, Illinois, shot and killed 48-year-old Kurt Milliman. Smith was prostituting his wife on craigslist out of their home and Milliman allegedly got to rough with Smith’s wife. Smith jumped out of hiding and shot Milliman. The couple tried concocting a home invasion story to try to hide their activity. However, investigators saw through the ruse and Smith was convicted of murder in 2013 and sentenced to 50 years behind bars.
In 2015, Smith was granted a new trial on the grounds that the judge at his trial did not allow an involuntary manslaughter charge to be considered by the jury. It was to no avail, however, as late last month, Smith was once again sentenced to 50 years behind bars for a conviction of first-degree murder. Smith has to serve his entire sentence without the possibility of parole.

More than likely to hide their criminal activities the Smiths concocted a home invasion story where they claimed that Milliman was killed in self-defense after tampering with evidence to try to make the scene look like an attempted burglary.

This past Tuesday Smith was granted a new trial on the grounds that the judge at his trial did not allow an involuntary manslaughter charge to be considered by the jury. Smith’s attorney claims that his client meant to scare Milliman and not kill him. I don’t buy it but it is what it is.
As I said before no one in this story was clean but I can see the grounds for involuntary manslaughter as Smith did not allow Milliman into his home with the ‘sole purpose of killing him. Then again, it was a killing in the commission of another crime so I can see the murder charge as well.
No word on when the retrial is scheduled to take place.

Today 28-year-old Timothy Smith of Woodstock, Illinois was convicted of first-degree murder for the May 2011 shooting of 48-year-old Kurt Milliman.
At the time Smith was prostituting his pregnant wife on craigslist and Milliman went to their home to use her ‘services’. According to Smith’s wife, Milliman was drunk and she asked him to leave. When Milliman tried to force the issue by allegedly slapping Smith’s wife Smith shot Milliman in the back with a .38. However, instead of calling police Smith tried to make the crime scene look like a break in by breaking a window and rearranging various items in the home. Meanwhile, Milliman was still alive and bleeding to death. Smith claims he did this because he was ashamed of what he and his wife were doing. I’m sure it had nothing to do with the fact that he didn’t want to be arrested for pimping his pregnant wife.
Smith is facing 45 to 85 years while his wife was granted immunity from the murder charges for her testimony. He is scheduled to be sentenced in late April.
While justice has been served there are no good guys in this story, only bad guys. Smith was turning out his pregnant wife while Milliman was supposedly violent towards her when she refused his money. All during a time when craigslist had supposedly gotten rid of prostitution ads on their site. If only one of the parties involved actually acted like a responsible human being none of this would have happened.
UPDATE 6/3/2013: Timothy Smith was sentenced to 50 years. His wife is looking at 1 to 6 and will be sentenced later this week.
UPDATE 6/16/2013: Smith’s wife was sentenced to two years probation.

Woodstock couple plead not guilty to charges:
Timothy and Kimberly Smith of Woodstock, Illinois have pleaded not guilty to the charges against them which led to the shooting death of 48-year-old Kurt Milliman.
If you’ll recall Mr. Milliman allegedly responded to a craigslist ad where Timothy Smith was advertising the prostitution services of his wife. Sometime during the night police say that Timothy Smith shot and killed Mr. Milliman and the couple allegedly concocted a burglary/self-defense explanation for the killing.
Timothy Smith is charged with first-degree murder, pandering, obstructing justice, and pimping. He’s looking at 45 to life. His wife has been charged with obstructing justice, disorderly conduct, and prostitution.
Smith the husband is said to have wept at his plea hearing. Aw, poor baby. You at least still have your life, Kurt Milliman does not.

Police: Couple concocted break-in story:
Police investigating the murder of 48-year-old Kurt Milliman say that his assailant and his wife tried to concoct a home invasion self-defense story. They say that Timothy and Kimberly Smith tried to make it seem that Mr. Milliman broke into the house while Timothy Smith was not there.
As you may recall police say that Milliman was there because he responded to a prostitution ad on craigslist that the Smiths had placed.
Police say that Timothy Smith allegedly instructed his wife to call his cell phone to make it look like that he wasn’t there at the time of the shooting. So it seems that not only was he trying to cover up that he was pimping his wife out on craigslist but that he may have been trying to implicate her in the murder as well.
What a classy group of people but not surprising for craigslist.

Man who served as wife’s pimp charged in killing:
Add yet another name to the ever increasing list of so-called ‘craigslist killers’. 26-year-old Timothy Smith of Woodstock, Illinois is accused of shooting and killing 48-year-old Kurt Milliman during a craigslist prostitution transaction.
From what I can gather Smith was allegedly pimping out his wife, 28-year-old Kimberly Smith, on craigslist. Milliman was at their home in Woodstock supposedly seeking the services of Smith’s wife. At some point an altercation took place and police say that Smith shot Milliman.
Smith called the police and when they arrived Milliman was still alive but he later died from the gunshot.
Yet again this highlights a few things. The first is obviously that prostitution is obviously still going on through craigslist. The second is that anytime you use the services of a prostitute you’re running a great risk that you could be the victim of a violent crime. Of course lastly, craigslist still needs to moderate the casual encounters section because this is obviously where the prostitution ads have migrated too.
